The People’s National Congress (PNC) has expressed grave concerns over Supreme Court Justice Husnu Al Suood’s recent resignation, highlighting potential threats to the judiciary’s impartiality.
In a recent press release, the PNC emphasized that the Maldivian constitutional framework is built on the separation of powers, ensuring that each branch holds the others accountable, with independent institutions providing oversight. The judiciary, in particular, is entrusted with safeguarding citizens’ rights and delivering justice, remaining detached from political influences.
The PNC underscored that judges engaging in political activism, whether during their tenure or upon resignation, is not sanctioned by the legal system. Such actions risk eroding public trust in the judiciary and could propel the judicial branch into political arenas.
Justice Suood’s method of resignation, according to the PNC, indicates a continuation of his prior political activism. Notably, he submitted his resignation directly to the President’s Office, bypassing the Judicial Service Commission (JSC) as mandated by law. The PNC interprets this move as an unfounded attempt to implicate the President, viewing it as clear evidence of Justice Suood’s political maneuvering.
The party further highlighted that Justice Suood, along with other Supreme Court judges, is being addressed within the constitutional and legal frameworks. They pointed out that the JSC’s procedures allow for the temporary suspension of judges under criminal investigation, a process that should proceed without exceptions.
President Dr. Mohamed Muizzu has empowered independent institutions to perform their duties autonomously, according to the PNC. They assert that when such bodies act within their legal mandates, it does not constitute interference with the judiciary but rather reflects the proper functioning of the constitutional system.
The statement concluded by lauding the President’s commitment to upholding the Constitution and the rule of law.
Justice Suood’s resignation comes amid an ongoing investigation by the Anti-Corruption Commission (ACC), which led to his suspension by the JSC. The ACC’s probe pertains to allegations from a 2022 incident, underscoring the gravity of the situation.
The PNC’s stance reflects a broader concern about maintaining the judiciary’s independence and preventing political encroachments that could undermine public confidence in legal institutions.
