In a decisive move to overhaul the Maldives’ justice system, President Dr. Mohamed Muizzu has announced comprehensive reforms aimed at eradicating the long-standing issue of prolonged pre-trial detentions, colloquially known as “Vaanuvaa.” This term has become synonymous with the plight of individuals held for extended periods without trial, some languishing in custody for over six years.
During the latest episode of his podcast, “Rayyithunnaa Eku,” President Muizzu reaffirmed his administration’s commitment to addressing this pressing concern. He emphasized that the root cause lies in delayed investigations and inadequate judicial infrastructure. To combat this, the government is expediting the construction of a new court complex in Hulhumalé, designed to facilitate multiple trials simultaneously, thereby alleviating case backlogs.
Currently, over 300 individuals are in pre-trial detention, with charges ranging from assault and child sexual abuse to terrorism and drug-related offenses. Recognizing the urgency, President Muizzu has initiated a review of at least one-third of these cases, exploring options like monitored release through electronic tagging, particularly for minor offenses or cases with insufficient evidence.
In tandem with judicial reforms, the administration is committed to upholding human dignity within detention facilities. Acknowledging reports of substandard conditions, the government is conducting feasibility studies for a new, centralized prison system aimed at unifying correctional facilities across the Maldives.
President Muizzu’s manifesto pledge includes overhauling the bail system, which he describes as costly and inaccessible. The proposed reforms will focus on non-major offenses, ensuring that individuals accused of serious crimes, such as child sexual abuse, remain excluded from these provisions.
To foster a collaborative approach to judicial reform, two national forums have been convened this year, engaging key stakeholders both within and outside the judiciary. These forums aim to build consensus and chart a path forward for a more efficient and fair legal system.
President Muizzu’s comprehensive strategy reflects a commitment to restoring public trust in the judiciary and ensuring that justice is administered promptly and humanely. By addressing systemic issues and investing in infrastructure, the Maldives is poised to transform its legal landscape and uphold the rights of all citizens.
